The Skill Games Regulations 2017 seek to distinguish skill games from certain other types of games of chance, and games of chance and skill that are currently licensed under the Remote Gaming Regulations.
The new regulations seek also to ensure that the highest standards are maintained by operators through ensuring that games are conducted in a fair and transparent manner and free from crime or irregular activity.
Type of Licenses
Corporate entities may apply for one or both of the following license types which are valid for five years:
- Controlled skill games service (Business-to-Consumer) means making a controlled skill game available for participation by end customers, whether directly or indirectly, and whether alone or with others;
- Controlled skill games supply (Business-to-Business) means the organisation of a controlled skill game for or with a controlled skill game operator.
The application process entails the submission of an application including the following documentation:
- Corporate and personal information
- Business plan
- Company procedures
- Terms and conditions
- Agreements with business parties
An applicant for a skill game license must be able to satisfy the Malta Gaming Authority (MGA) that the activity it intends to offer is a skill game. The Authority shall examine the documentation submitted by an applicant, including any studies, research, rulings or certification prior to making such a determination.
The Malta Gaming Authority will undertake the 'fit and proper' test with regards to the applicant and the involved persons, including shareholders, directors, CEO and UBOs.
The fees due to the MGA include:
- A one-time application fee of € 2,300;
- A renewal fee, due on renewal of the license after five years of € 2,300
- An annual license fee of € 8,500 paid annually in advance.
